These Rules & Conditions are designed to ensure a safe, enjoyable, and memorable experience for all guests. By booking Bajo La Luna, the renter (“Client”) agrees to comply with the following:

1. Booking & Payment

• A non-refundable deposit of 50% of the rental fee is required to secure the date.
• The remaining balance is due no later than [14 days] before the event.
• A refundable security deposit of $100 is required. This covers damages, overtime, or violations. Unused portions will be returned within 7 business days.

2. Rental Time & Overtime

• Rental time includes set-up and breakdown. Please plan accordingly.
• Exceeding contracted time will result in an overtime charge of $40/hour, deducted from the security deposit.
• Events must conclude by 2:00 am, unless expressly authorized.

3. Capacity & Use of Venue

• Maximum occupancy is 60 guests, in compliance with fire and safety codes.
• Bajo La Luna may not be used for illegal, unsafe, or disruptive activities.
• Subleasing, reselling tickets, or unauthorized commercial activity is prohibited.

4. Catering, Beverages & Alcohol

• Catering services must be pre-approved. Outside vendors must provide proof of insurance.
• Alcohol consumption is permitted under the following conditions:
  • No service to guests under 21.
  • If alcohol is sold, the Client must secure a valid liquor license.
  • Client assumes full responsibility for guest conduct and compliance with laws.

5. Conduct, Noise & Music

• Music and entertainment must comply with local noise regulations.
• Excessive noise, disorderly conduct, or abusive behavior will result in immediate termination of the event without refund.
• Client is responsible for guest behavior at all times.

6. Decorations & Setup

• No nails, screws, or adhesives that damage surfaces may be used.
• Open flames (candles, lanterns) are only permitted with prior approval.
• The venue must be returned to its original condition at the end of the rental.

7. Cleaning & Damages

• Client is responsible for all trash removal, packaging, and disposal in designated bins.
• Any damages will be assessed and deducted from the security deposit; renter is liable for excess damages.

8. Swimming Pool Rules

To preserve safety and the serene ambiance of Bajo La Luna, the following rules apply to all events involving pool access:

• Use at Own Risk: Bajo La Luna does not provide lifeguards. All pool use is strictly at guests’ own risk.
• Supervision of Children: Children under 16 must be accompanied and supervised by a responsible adult at all times. Parents and guardians assume full responsibility for the safety and behavior of their children.
• Prohibited Activities:
  • Diving, running, or horseplay near the pool.
  • Glass containers in or around the pool area.
  • Unauthorized inflatables or large floatation devices.
• Pool Hours: Swimming is permitted only during agreed rental hours. After dark, pool lighting must remain on.
• Liability Waiver: Bajo La Luna is not responsible for accidents, injuries, or drowning incidents. The Client assumes full responsibility for ensuring all guests comply with pool rules.

9. Insurance & Liability

• Client may be required to provide a certificate of insurance, naming Bajo La Luna as additional insured.
• Bajo La Luna shall not be held liable for accidents, injuries, theft, or loss of personal property.
• Client assumes all responsibility for guests’ safety and conduct.

10. Cancellation Policy

• Deposits are non-refundable.
• Cancellations made less than 30 days prior to the event date will result in forfeiture of all payments.
• In cases of force majeure (natural disasters, government restrictions, etc.), Bajo La Luna may offer credit for rescheduling.

11. Compliance

• Client agrees to abide by all federal, state, and local laws and regulations.
• Any violation may result in termination of the rental agreement, loss of deposit, and removal from the property.
